Terms of Use

Please read these Terms of Use ("Terms") carefully before using the AI Coloring Page Generator mobile application (the "App") operated by Appcellent Yazilim Hizmetleri A.S. ("Appcellent," "we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Use of the App

The App is an AI-powered creative tool that turns photos and text prompts into printable coloring pages, offers a gallery of ready-made coloring templates, and lets you print and export your coloring pages.

You agree to use the App only for lawful purposes and in accordance with these Terms. You must be at least 13 years of age to use the App. If you are under 18, you must have your parent's or guardian's permission to use the App.

2. Account and Data

Your settings and saved coloring pages are stored on your device. Photos and text prompts you submit are processed as described in our Privacy Policy. You are responsible for maintaining the security of your device and the data stored on it.

3. Subscriptions and In-App Purchases

3.1 Free Use

The App provides one free coloring page generation so you can try the core experience. Once your free generation has been used, continued access to AI generation and other premium features requires a paid subscription.

3.2 Premium Subscription

The App offers premium subscription plans that unlock additional features, including but not limited to: unlimited Photo to Coloring Page generation, unlimited Text to Coloring Page generation, the full template gallery, and high-quality print & export.

3.3 Subscription Plans

Subscription options and pricing are displayed within the App at the time of purchase. Prices are subject to change, and any changes will be communicated before your next billing period.

3.4 Billing and Renewal

  • Payment will be charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period, at the same price as the original subscription.
  • You can manage your subscriptions and turn off auto-renewal by going to your Apple ID Account Settings after purchase.
  • Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
  • Prices are in US dollars (USD) and may vary in other countries. Actual charges may be converted to your local currency depending on your country of residence.

3.5 Cancellation

You may cancel your subscription at any time through your Apple ID account settings or the App Store. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

3.6 Refunds

All purchases are processed by Apple through the App Store. Refund requests must be submitted to Apple in accordance with their refund policies.

4. AI-Generated Content

4.1 Nature of AI Generation

Coloring pages are created using artificial intelligence based on the photos and text prompts you provide. Results are generated automatically and may vary in quality, accuracy, or style. We do not guarantee that any generated coloring page will meet your specific expectations.

4.2 Your Content and Responsibility

You are solely responsible for the photos and text prompts you submit. You represent and warrant that you own or have the necessary rights to any photo you upload, and that your submissions do not infringe the intellectual property, privacy, or other rights of any third party.

You agree not to submit content that is unlawful, infringing, harmful, hateful, sexually explicit, or that depicts identifiable individuals without their consent.

4.3 Ownership of Output

Subject to your compliance with these Terms and the rights of any third parties in your source material, the coloring pages you generate are yours to use for personal and lawful purposes. Because AI-generated outputs may not be unique, similar content may be generated for other users, and we make no representation regarding the copyrightability of generated outputs.

5. Intellectual Property

5.1 App Content

The App, including its design, features, code, template gallery, and original content, is the property of Appcellent and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

5.2 Photo Access

The App requires your permission to access the photos you select for generation. The App accesses only the photos you choose and does not modify or delete your original photos.

6. Prohibited Conduct

You agree not to:

  • Use the App for any illegal or unauthorized purpose.
  • Attempt to reverse engineer, decompile, or disassemble the App.
  • Interfere with or disrupt the App's functionality or infrastructure.
  • Use automated systems, bots, or scripts to access or interact with the App.
  • Circumvent or attempt to circumvent subscription restrictions, generation limits, or payment requirements.
  • Submit content you do not have the rights to, or content that infringes the rights of others.
  • Use the App to generate harmful, abusive, or otherwise objectionable content.

7. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT WARRANT THAT AI GENERATION RESULTS WILL MEET YOUR EXPECTATIONS OR BE ACCURATE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APPCELLENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless Appcellent and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the App, your submitted content, or violation of these Terms.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall remain in effect.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the App after any modifications constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Appcellent regarding your use of the App and supersede any prior agreements.
